Terms and conditions
For all participants of the DANCEIMPERIAL Festival.
1. Scope
These terms and conditions apply to all participants of the DANCEIMPERIAL Festival. Participants are all persons who have purchased a ticket of any kind for the DANCEIMPERIAL Festival.
2. Organiser and venue
The DANCEIMPERIAL Festival is organised by DANCEIMPERIAL GmbH, Dr.-Gessler-Str. 41, 93051 Regensburg, Germany. Any claims must always be directed at the organiser.
The venue for the DANCEIMPERIAL Festival is the DANCEIMPERIAL dance school, Dr.-Gessler-Str. 41, 93051 Regensburg, Germany.
3. Reserving a festival ticket
By submitting the online form, the participant makes an application for the selected ticket and the services associated with it. This application is a binding offer and therefore subject to charge, and is accepted upon confirmation by DANCEIMPERIAL GmbH. The corresponding ticket is thereby reserved for the participant.
Before submitting, agreement to the terms and conditions set out here is required.
All ticket bookings are binding and non-transferable.
4. Right of withdrawal
There is no right of withdrawal. Event tickets for the DANCEIMPERIAL Festival are date-related services in the field of leisure activities, for which the right of withdrawal is excluded by law.
5. Payment of the ticket
The purchase price of reserved tickets is collected by DANCEIMPERIAL GmbH by direct debit from the account stated by the participant when booking the ticket. As a rule, the amount is debited within three weeks of the booking. The participant undertakes to ensure that the account has sufficient funds.
If the account does not have the necessary funds, the account-holding bank is under no obligation to honour the debit. Partial collection is not carried out in the direct debit procedure. Any chargeback fees incurred are borne by the party causing them. A fee of 7.00 € is charged to the customer causing the chargeback for the administrative work involved.
The participant receives the personal digital ticket by email once the ticket price has been successfully debited.
6. Collection and use of tickets
On presentation of the digital or printed ticket, the participant receives the ticket at the check-in of the DANCEIMPERIAL Festival in the form of a wristband which entitles them to use the respective ticket. Digital tickets and wristbands may not be used improperly, copied or altered.
Check-in is located at the venue. The opening hours of the check-in will be announced in good time on the website of the DANCEIMPERIAL Festival.
If contingents are still available, tickets can also be purchased directly at the check-in against payment in cash or by debit card.
Participants are themselves responsible for safely keeping tickets purchased in digital form as well as wristbands issued. The organiser accepts no liability; tickets that are lost cannot be replaced.
All wristbands issued must be attached to the wrist before attending the relevant festival content, in such a way that they cannot be pulled off over the hand. They must be worn throughout the DANCEIMPERIAL Festival and shown on request. Without the corresponding wristband, the participant will not be admitted to the workshop. Replacement wristbands cannot be provided.
7. Cancellation of the event, changes, refunds
The organiser reserves the right to change the schedule, the instructors, the parties or the programme; such changes do not entitle participants to return tickets purchased.
Should the DANCEIMPERIAL Festival have to be cancelled by the organiser, participants may return paid tickets up to 60 days after the original end of the festival and will be refunded the purchase price. This return and the refund are made by the same route as the purchase. Payment in cash is excluded.
In the event of a cancellation, a postponement or changes to the programme or the line-up, costs such as travel, hotel or other fees will not be reimbursed by the organiser.
8. Liability
Liability begins when the venue of the DANCEIMPERIAL Festival is entered and ends when it is left. Being present and dancing at the venue is at your own risk. Participants are solely liable for any injuries or damage. The organiser is liable for damage caused by its vicarious agents only in cases of intent and gross negligence.
No teaching success is warranted for the content of the tuition.
No liability is accepted for the cloakrooms at the venue.
9. Data protection
Reference is made to the data protection provisions of the organiser, DANCEIMPERIAL GmbH. The privacy policy of the festival applies to the DANCEIMPERIAL Festival.
10. Photography, video recordings, copyright
During the DANCEIMPERIAL Festival, photographs and film recordings are made by the organiser or by third parties commissioned by it. By booking a ticket, the participant agrees to this and assigns all image rights to the organiser free of charge.
The organiser may use these photographs and film recordings both for further marketing purposes for the DANCEIMPERIAL Festival, for the current and the following years, and for further commercial purposes. To this end it may publish the photographs and film recordings at its discretion, including online. All rights of use lie with DANCEIMPERIAL GmbH.
During the workshops, participants may take their own photographs and film recordings only when invited to do so by the instructors at the end of the workshops. In the event of a breach, a fee of 300.00 € is charged. In such a case the organiser is also entitled to demand the surrender of photographs and video recordings already made, without compensation, and to exclude the participant concerned from the DANCEIMPERIAL Festival.
11. Changes to the terms and conditions
The organiser is entitled to change or supplement the content of these terms and conditions unilaterally insofar as this is necessary for legal reasons or the changes or additions are exclusively to the advantage of the customer. In all other cases, a unilateral change or addition to the services, the registration and these terms and conditions is only permissible if it is reasonable for the customer, taking the interests of the organiser into account.
In such cases the organiser will notify participants of a change or addition in writing or by email at least four weeks before it takes effect (notice of change).
The customer may object to such a change or addition by email to the organiser within four weeks of receiving the notice of change. In this case the reservation of the participant’s ticket lapses and any ticket prices already paid are refunded.
If no objection is raised, the changes or additions become effective. The organiser will specifically point out the legal consequences of a failure to object in the notice of change.
12. Final provision
Should one or more provisions of these conditions be or become invalid, this does not affect the validity of the terms and conditions or of their remaining provisions. The invalid provisions are replaced by the legally permissible provision that comes closest to what was intended. This also applies in the case of an unintended gap in the provisions.
13. Place of jurisdiction
The place of jurisdiction is Regensburg, Germany.
